Decision of the Council of Private Enforcement Officers of Ukraine No. 87

Council of Private Enforcement Officers of Ukraine

A meeting of the Council of Private Enforcement Officers of Ukraine (hereinafter – CPEOU) convened by the Chairman of the CPEOU and organised in accordance with the Law of Ukraine “On Bodies and Persons Enforcing Court Decisions and Decisions of Other Bodies” and clause 6.15 of the CPEOU Charter.

The meeting was attended by 20 members of the COA.

According to the agenda ,the Council of Private Enforcement Officers of Ukraine adopted the following decisions:

1. Having reviewed and discussed the issue of judicial appeal by the Association of Private Enforcement Officers of Ukraine against the Order of the Ministry of Justice of Ukraine dated 13 August 2025 No. 2204/5 “On Amendments to Certain Regulatory Acts of the Ministry of Justice of Ukraine”, the Council decided to appeal the said Order in court in the part concerning the recovery of the main remuneration of a private enforcement officer, namely, the extension of part five of Article 27 of the Law of Ukraine “On Enforcement Proceedings” to the main remuneration of a private enforcement officer.

2. Having reviewed and discussed the issue of convening the next Congress of Private Enforcement Officers of Ukraine scheduled for 14 November 2025, decided to set the venue for the Congress at Radisson Blu Hotel, Kyiv City Centre (22 Yaroslaviv Val St., Kyiv) and supplement the draft tentative agenda of the next Congress of Private Enforcement Officers of Ukraine with items:

– “On appointment of the Chairman and members of the Audit Commission“;

– “On Amendments to the Regulations on the UNPA Audit Commission”.

3. Having considered the application of Nataliia Volkova, a member of the Expert (Scientific and Advisory) Council, for termination of her powers, the Board decided to terminate her powers as a member of the Expert (Scientific and Advisory) Council and exclude her from the Board.

4. Having reviewed and discussed the Draft Law of Ukraine “On Amendments to Section III “Final and Transitional Provisions” of the Law of Ukraine “On Enforcement Proceedings ” (Reg. No. 14061 of 22 September 2025), decided to express support for the said draft law and to inform the Verkhovna Rada Committee on Legal Policy of this decision.

5. Having reviewed and discussed the Draft Law of Ukraine “On Amendments to Certain Laws of Ukraine on Simplification of Enforcement Proceedings through Digitalisation” (Reg. No. 14005 of 04 September 2025), decided to postpone consideration of this issue until an agreed position on the proposed amendments is developed.

6. Consideration of complaints against actions (inaction) of private enforcement officers.

I. To refuse to open disciplinary proceedings and return appeals (complaints) without consideration:

– complaint of V.I. Kreposniak dated 12.09.2025 against the actions of private enforcement officer Y.B. Horelyk
– the complaint of Gerasymenko L.V. dated 05.09.2025 against the actions of the private executor Mukorez O.L;
– complaint of Matvienko N.M. dated 10.09.2025 against the actions of private executor Mukorez O.L;
– the complaint of the lawyer Valk I.V. in the interests of Khvostenko N.M. dated 15.09.2025 against the actions of the private executor Dubrovin S.I;
– the complaint of Nemyrych Y.I. dated 24.09.2025 against the actions of the private executor Lavrinenko Y.V;
– the complaint of Kolizhuk O.O. dated 29.09.2025 against the actions of the private executor Dzhubaba D.O;
– complaint of Makhovskyi A.P. dated 03.10.2025 against the actions of private executor Dzhubaba D.O;
– the complaint of the representative of JSC CB PrivatBank A.S. Vegera dated 16.09.2025 against the actions of the private executor B.O. Protchenko;
– the complaint of the lawyer Vasylchenko G.I. in the interests of Serdyuk T.I. dated 16.09.2025 against the actions of the private executor Nordio V.V;
– the complaint of the representative of JSC CB PrivatBank A.S. Vegera dated 23.09.2025 against the actions of the private executor Umanets N.O;
– complaint of I.O. Kornilyuk dated 17.09.2025 against the actions of private executor M.V. Dogotar;
– complaint of V.I. Liutak dated 15.09.2025 against the actions of private executor M.V. Dogotar;
– complaint of Pasak Y.V. dated 22.09.2025 against the actions of private executor Varava R.S;
– complaint of Latz M.K. dated 18.09.2025 against the actions of private executor Makarenko A.S.

II. To open disciplinary proceedings on the appeal (complaint) against the actions of private enforcement officers and send a request to the CAAU Ethics Committee to provide conclusions on the presence or absence of signs of violation of the Code of Professional Ethics in the actions:

– private enforcement officer Shevtsov I.V. for the appeal of lawyer Lipovyi I.V. in the interests of Samarin O.V. dated 12.10.2025;
– private enforcement officer Biletskyi I.M. on the complaint of lawyer Karpliuk L.R. in the interests of VT DEVELOPMENT LLC dated 12.09.2025;
– Private Enforcement Officer Biletskyi I.M. on the complaint of lawyer Nynyuk I.V. in the interests of ALARIMA LLC dated 24.09.2025;
– Private Enforcement Officer Solonko M.M. on the appeal of the Chairman of the Board of INGO Insurance Company A.L. Semchenko dated 22.09.2025;
– private enforcement officer Melnychenko K.P. on the complaint of the Director of LLC FC WINSTAR T.V. Lanova dated 01.10.2025;
– private enforcement officer Protchenko B.O. on the complaint of lawyer Kovalev V.M. in the interests of Kovalenko V.V. dated 08.10.2025;
– private enforcement officer Yarushevska T.I. on the appeal of Ivanyshyn V.V. dated 13.10.2025.
